移民局再出新冠特殊政策：初创签证可多获一年效期

英国移民局最新更新了有关初创签证（Start-up）的指导文件。

文件当中新增了有关“Concession”（特别许可）内容。

简单说，这个“特别许可”是因应新冠疫情而设立的，目的在于给予受疫情影响的申请人，可以再申请额外12个月的延长签证。

→ 为什么需要延长签证？

初创签证（Start-up）本身是不具备永居导向的，而且设有持有上限，也就是申请人持有初创签证的总时长，最多不超过两年。

这代表，对于持有初创签证的当事人来说，如果想要继续留在英国，一般必须通过转换到其他签证类别（最常见的是转成创新签证－Innovator），才能继续合法居留甚至往后申请转永居。

对于初创签证持有人来说，虽然这类签证不具永居导向，但申请人可以通过持有初创签证的期间，发展自己的事业以准备在两年后，能够达到创新签证的相关要求，然后顺利转换成具备永居导向的创新签证。

然而受到新冠疫情的严重影响，可能会导致申请人无法像原计划那样，在持有初创签证两年后便能够达到“创新签证”的要求；也因此，移民局才会出台新的“特别许可”政策，让符合条件的当事人可以获得额外一年的时间，让事业可以慢慢重回轨道。

移民局文件指出，想要申请“特别许可”，也就是再额外延签一年，申请人必须是正持有初创签证的，也就是持有初创签证的第一年或第二年。

同时，当事人的企业必须是受到了新冠疫情的不利影响。

在申请这额外一年签证的时候，当事人依旧需要满足初创签证申请的所有相关要求，这包括了必须事先获得合格担保机构的担保。

虽然说这类“延签”属于“特别许可”，是移民局为了因应新冠而给出的特殊政策；但这不代表当事人都可以被自动延签一年，也不是申请就一定成功的。

当事人还是需要满足初创签证的相关要求；同时，担保机构在给出担保之前，也还是需要经过谨慎考虑和评估的。

当然了，担保机构进行评估的时候，是也需要把新冠疫情的情况给考量进去的。

如果申请人成功获得“延签”，在持有这额外一年签证的期间，仍需要遵守初创签证的相关要求。

这代表，当事人不能够申领英国福利，不能做牙医或医师培训工作（Doctor/Dentist in training），也不能做职业运动员。

同时，如果当事人是需要向警局注册的（如中国籍申请人）；拿到这额外一年“延签”后，也需要去向警局注册。

根据移民局文件，这类“延签”只能申请一次。

也就是说，对于符合条件的初创签证持有人来说，在这样的“特别许可”下，最长可以持有该签证的总年限是3年（也就是比原来两年要多出一年）。

如果当事人未来仍然想继续留在英国，依旧需要在签证到期前，转换成其他的合法签证（如常见的“创新签证”）。

或者是说，假如多了这一年，当事人就可以满足“10年合法居留”，那么也可以申请”10年合法永居”。

至于“陪同家属”方面，虽然文件中没有详细写出。

但丽莎认为，既然“初创签证”原来就是允许携带陪同家属的；因此当事人申请“延签”，家属也自然可以一起申请。

基本上，这类“延签”对于申请人的要求，是和原来“初创签证”申请一致的。

这基本指的是当事人/主申请人的：

－合法配偶，民事伴侣，或同居至少满两年的未婚伴侣；

－未成年孩子。
